During 2005, fifty schools in the independent schools sector in the UK were the subject of an investigation by the Office of Fair Trading (OFT) into the sharing of fee information. The exchange of fee information took place in the academic years 2001/02 to 2003/04. To see a list of the relevant schools click here.

As part of the agreed resolution of the OFT's investigation, the schools involved agreed to make ex gratia payments totaling three million pounds into a charitable trust designed to benefit pupils who attended the schools during the period in respect of which the fee information was shared. The three million pounds is being paid in five equal annual instalments the first of which was received in December 2006.

This Trust was established in November 2006 with Trustees appointed by the Chairman of the OFT after consultation with the Charity Commission and those who paid fees to the schools during the period. The Trust's first awards were made in respect of the academic year 2007-08.

The objects of the Trust are to:
  • Make awards or bursaries to beneficiaries which can be used in pursuit of higher or further education;
  • Provision of financial assistance, including equipment and travel, to beneficiaries in the pursuit of their studies or research; and
  • Otherwise furthering the education of the beneficiaries.
The Trust is independent of both the schools and the OFT.
